Fortuna Terra is committed to protecting your privacy. This policy explains what personal information we collect when you visit our website or get in touch with us, what we do with it, and the rights you have over it.

Fortuna Terra Ltd is a UK property developer at 91-97 Saltergate, Chesterfield, S40 1LA. When we say "Fortuna Terra", "we", "us" or "our" in this policy, we mean Fortuna Terra Ltd.

We are the "data controller" for the personal information described here, which means we decide how and why it is used.

If you have any questions about this policy or how we use your information, email us at info@fortunaterra.co.uk.

Information collected automatically. When you visit our website, some technical information is shared automatically, such as your IP address, browser type and device. This happens because our website host keeps standard server logs, and because our web fonts are loaded from Google Fonts, which means your browser connects to Google's servers. We don't use this information to identify you.

We will never sell or rent your details to anyone else for their own marketing.

We don't sell your personal information. We only share it where we need to, with:

  • Our contact form provider. Messages sent through our website are delivered to our inbox by Web3Forms.
  • Our website, email and IT providers, who host our website and store our emails and files on our behalf.
  • People who help with your purchase, such as the solicitors on our panel and the independent mortgage advisers we introduce you to, only where it's needed to deal with your enquiry or purchase.
  • Professional advisers, such as our accountants and lawyers, where it's needed for their work and they're bound by confidentiality.
  • Anyone we're legally required to share it with, such as HMRC, the police or a regulator.
  • A buyer of our business. If Fortuna Terra, or part of it, is ever sold or merged, your information may be passed to the new owner, who can use it in the same ways as set out in this policy.

Everyone we share your information with is required to keep it secure and only use it for the reason we gave it to them.

Some of our service providers may store or process information outside the UK. Where that happens, we make sure appropriate protections are in place, for example the country has been recognised by the UK government as offering adequate protection, or the provider has signed the UK's approved data transfer agreement.

Our website doesn't use advertising or tracking cookies. If this changes, we'll update this policy and ask for your consent first where the law requires it. You can also set your browser to block or delete cookies at any time.

We only keep your information for as long as we need it for the reasons above:

  • Enquiries are kept while we're in touch with you about them, and deleted once they're no longer needed.
  • Buyers' records are kept for as long as needed to complete the sale and handle any aftercare, and then for up to six years to meet legal, tax and accounting requirements.
  • Marketing, if you've signed up, until you unsubscribe.

We may keep information for longer if there's a complaint or a legal dispute.

Our website uses an encrypted (HTTPS) connection, access to our inbox and records is limited to the people who need it, and our service providers are required to protect your information too.

No method of sending information over the internet is completely secure, so we can't guarantee the security of information while it's on its way to us. Once we receive it, we take appropriate steps to protect it from loss, misuse or unauthorised access.

Under data protection law, you have the right to:

  • Access: ask for a copy of the personal information we hold about you.
  • Correction: ask us to correct anything that's wrong or incomplete.
  • Erasure: ask us to delete your information where there's no good reason for us to keep it.
  • Restriction: ask us to limit how we use your information in certain situations.
  • Objection: object to us using your information where we rely on legitimate interests, including for marketing.
  • Portability: ask us to send your information to you or another organisation in a commonly used format, in certain situations.
  • Withdraw consent: where we rely on your consent, you can withdraw it at any time.

To use any of these rights, email info@fortunaterra.co.uk. There's no charge, and we'll reply within one month. We may need to confirm your identity before we act on a request.

If you're unhappy with how we've handled your information, please contact us first at info@fortunaterra.co.uk and we'll do our best to put it right.

You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data protection regulator.

We may update this policy from time to time, for example if we start using a new service or the law changes. The latest version will always be on this page, with the date it was last updated at the top.
